Delhi's assembly elections are scheduled for next month. Prior to then, the Aam Aadmi Party was uneasy. In the Delhi liquor policy scam case, the Ministry of Home Affairs (MHA) has permitted the Enforcement Directorate (ED) to move on with legal action against former Delhi Chief Minister and AAP convenor Arvind Kejriwal and former Deputy Chief Minister Manish Sisodia. Lt. Governor VK Saxena of Delhi has approved this last month.
Earlier, Arvind Kejriwal had already gone to jail in the excise policy corruption case. He is currently out on bail.
On November 6, the Supreme Court had said that no public representative can be prosecuted under the Prevention of Money Laundering Act without the consent of the state government. From the very beginning, the consent of the state government was required for filing charge sheets against public representatives by the CBI and the police. However, the investigating agency ED was excluded from this. Later, they were also added to this list. The ED had approached the Lt Governor on December 5.
Following the Supreme Court verdict, Kejriwal had moved the Delhi High Court challenging the ED probe. The former chief minister said the ED did not have the sanction to probe against him.
Now the approval of the Ministry of Home Affairs has also removed that obstacle. Arvind Kejriwal or Manish Sisodia have not stopped the ED from probing anyone in the Delhi excise policy scam.
Arvind Kejriwal and Manish Sisodia were arrested in connection with the Rs 1,000 crore excise policy scam. Both are currently free on bail. They claimed that the allegations of corruption against them were false. The BJP is misusing its power and using the ED-CBI.
