The Supreme Court on Monday dismissed the bail plea of former Delhi deputy chief minister Manish Sisodia. Sisodia was arrested in the alleged Delhi liquor policy scam.
A bench comprising Justices Sanjiv Khanna and S V N Bhatti said, "An aspect has been established temporarily with regard to the transfer of funds worth Rs 338 crore. We have dismissed the bail application.
On October 17, the Supreme Court had reserved the order on Sisodia's bail plea. During the hearing, senior advocate Abhishek Manu Singhvi, representing Sisodia, submitted before a bench comprising Justices Sanjeev Khanna and SVN Bhatti that there was no allegation of bribery against Sisodia for a CBI predicate offence under the Prevention of Money Laundering Act (PMLA).
Singhvi stressed that if there is no predicate offence, then there cannot be ED and bribery is not part of the predicate offence with regard to amendments in the liquor policy with respect to airport licences.
It may be recalled that central agencies have alleged that AAP had used the funds to campaign in the Goa assembly elections. They also claimed that AAP had given liquor licences in lieu of money it received from stakeholders.
